DMCA Copyright Policy

1. Overview

AeroDaily respects the intellectual property rights of others and expects our users to do the same. We comply with the Digital Millennium Copyright Act ("DMCA") and have adopted the following policy concerning copyright infringement.

It is our policy to respond to clear notices of alleged copyright infringement. This page describes the information that should be included in these notices and our procedure for addressing claims of copyright infringement.

2. How AeroDaily Works

AeroDaily is a news aggregation platform. We:

  • Collect headlines, excerpts, and images from publicly available RSS feeds
  • Display brief summaries (typically 100-300 characters) of articles
  • Link directly to the original source for the full article
  • Do not host full articles or reproduce complete works
  • Provide attribution to the original publisher

We believe our use of excerpts, headlines, and images constitutes fair use under U.S. copyright law as transformative news aggregation. However, we respect your rights as a content creator.

3. Opting Out (For Publishers)

If you are a publisher and prefer that your content not appear on AeroDaily, you can request removal without filing a formal DMCA notice:

We will promptly remove your RSS feed from our aggregation system (typically within 24-48 hours).

Technical Opt-Out (robots.txt)

You can also prevent AeroDaily from accessing your RSS feed by adding the following to your robots.txt file:

User-agent: AeroDailyBot
Disallow: /feed/
Disallow: /rss/

We honor robots.txt directives and will cease accessing your feed.

4. Filing a DMCA Takedown Notice

If you believe that content on AeroDaily infringes your copyright, you may submit a DMCA takedown notice. Your notice must include the following information:

1. Identification of the copyrighted work

Describe the copyrighted work you claim has been infringed. If multiple works, provide a representative list.

2. Identification of the infringing material

Provide the URL(s) of the specific content on AeroDaily that you claim is infringing. Be as specific as possible.

3. Your contact information

Include your name, address, telephone number, and email address.

4. Good faith statement

Include the following statement: "I have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law."

5. Accuracy statement

Include the following statement: "The information in this notification is accurate, and under penalty of perjury, I am the copyright owner or authorized to act on behalf of the copyright owner."

6. Physical or electronic signature

Provide a physical or electronic signature of the copyright owner or person authorized to act on their behalf.

5. Where to Send DMCA Notices

⚠️ Note: DMCA notices must comply with the requirements of 17 U.S.C. § 512(c)(3). Incomplete notices may not be processed.

6. Our Response to DMCA Notices

Upon receipt of a valid DMCA notice, we will:

  1. Promptly investigate the claim (typically within 2-5 business days)
  2. Remove or disable access to the allegedly infringing material if the claim is valid
  3. Notify the user who posted the content (if applicable)
  4. Terminate the accounts of repeat infringers

7. Counter-Notification

If you believe your content was removed in error or misidentification, you may file a counter-notification. Your counter-notification must include:

  • Your physical or electronic signature
  • Identification of the material that was removed and its location before removal
  • A statement under penalty of perjury that you have a good faith belief the material was removed by mistake
  • Your name, address, and telephone number
  • A statement consenting to jurisdiction in your district (or where AeroDaily is located)
  • A statement that you will accept service of process from the complainant

8. Repeat Infringer Policy

AeroDaily has a policy of terminating the accounts of users who are repeat copyright infringers in appropriate circumstances. We may also, in our sole discretion, limit access to the Service and/or terminate the accounts of users who infringe intellectual property rights, whether or not there is repeat infringement.

9. Misrepresentations

⚠️ Warning: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing or was removed by mistake may be subject to liability.

Please ensure your DMCA notice is accurate and made in good faith. False claims may result in legal consequences.

10. Fair Use Statement

AeroDaily believes that our practice of displaying article headlines, brief excerpts (100-300 characters), and thumbnail images constitutes fair use under U.S. copyright law for the following reasons:

  • Purpose and character: Transformative use for news aggregation and discovery
  • Nature of work: Factual news content
  • Amount used: Minimal excerpts (substantially less than the full work)
  • Effect on market: Drives traffic to original sources; does not substitute for the original

However, we respect the rights of copyright holders and will work with you if you have concerns.

11. For Publishers: Working Together

We view ourselves as partners with publishers in the aviation news ecosystem. AeroDaily:
